EBay doesn't really know what the rules or laws are, and it applies them at whim. Whether the auction is allowed to run or not is anyone's guess.

Well, they are consistent with this variety. I don't even count it as a screw-up when one comes back in the wrong holder in a bulk order.

The only photo I have of this one is the clashed E for the label. The coin is a bit "crunchy," so not every clash is going to show up as strongly as marks on the coin.
